Universal Ostrich Farms is preparing to petition the Supreme Court of Canada in an effort to halt the culling of 400 ostriches affected by avian flu. The farm's spokesperson, Katie Pasitney, indicated that the farm is hopeful the Supreme Court will consider their case.
The farm's request follows a ruling by Federal Court of Appeal Justice Gerald Heckman, who determined that the culling of the animals should proceed. Pasitney emphasized the importance of the animals' health as the primary reason for their legal battle.
The Canadian Food Inspection Agency (CFIA) initially ordered the slaughter on December 31, 2024, due to an outbreak of H5N1 avian flu, which had already resulted in the death of 69 ostriches. The farm has been contesting the cull order for several months, losing in both Federal Court and the Federal Court of Appeal.
Pasitney described the situation as an "open cull order" following the latest ruling. She reported that approximately 20 people were gathered outside the farm in Edgewood, B.C., showing support and awaiting further developments. The farm plans to file its application to the Supreme Court immediately.
Justice Heckman's ruling also stated that the farm had not provided sufficient grounds for a further appeal. He noted that the farm had been given ample opportunity to challenge the legality of the cull. The CFIA maintains that the ostriches and their living conditions pose ongoing risks.
