A Hong Kong court has concluded its hearing of final arguments in the national security trial of media tycoon Jimmy Lai. The court has stated that the verdict will be announced at a later date. The case has garnered significant international attention, with many viewing it as a critical test of Hong Kong's legal system under Chinese governance.
The trial, which commenced in December 2023, spanned 156 days and represents the most prominent case brought under Hong Kong's national security law. This law was enacted by Beijing in 2020, following the large-scale pro-democracy protests of 2019, and has been widely criticized as a means to suppress dissent.
Jimmy Lai, aged 77, is the founder of the now-defunct pro-democracy newspaper, Apple Daily. He faces charges of conspiracy to collude with foreign forces and conspiracy to publish seditious material. Lai has pleaded not guilty to all charges. If convicted, he could face a life sentence.
Prosecutors allege that Lai utilized Apple Daily to conspire with former executives and others to publish material that encouraged foreign countries to take action against China and Hong Kong. He is also accused of collaborating with activists to seek sanctions and blockades from various governments. Furthermore, he is alleged to have provided funding to the advocacy group Stand with Hong Kong.
Lai's legal team has strongly refuted these accusations. Defense lawyer Marc Corlett argued that there was no evidence to suggest Lai organized or directed any activities after the national security law came into effect. He also described a key prosecution witness as a "serial liar" and asserted that another activist acted independently of Lai.
Corlett further argued that Lai's mere following of Twitter accounts critical of Beijing did not constitute support for those groups. Another lawyer, Robert Pang, contended that the articles cited by the prosecution were not seditious and that the press should be granted broad freedom to report and comment.
Pang maintained that Lai's social media posts and online discussions were merely personal opinions, comparing them to casual political conversations. However, Judge Esther Toh disagreed, stating that public online forums carry different weight and that freedom of speech is not absolute.
The United States and other nations have expressed concerns, stating that Lai is being punished for his political views. Conversely, Chinese and Hong Kong authorities maintain that he is receiving a fair trial. The date for the verdict announcement will be disclosed at a later time.
