CMA Warns Against Restrictive Practices
The Competition and Markets Authority (CMA) has issued a stern warning to schools regarding their uniform policies, urging them to ensure their policies are not overly restrictive and comply with competition law. This follows an investigation into the impact of rigid uniform policies across the country.
While acknowledging the importance of uniforms in fostering a sense of identity among students, the CMA highlighted the significant financial burden they can place on families. The investigation revealed that the cost of uniforms, coupled with expenses associated with childcare and entertainment during the summer holidays, can pose a major challenge for many families.
The CMA is not advocating for a complete overhaul of school uniforms, but it is urging schools to consider several key factors when assessing the flexibility of their policies. This includes examining exclusivity contracts and deals with uniform suppliers that could potentially breach competition law. The CMA specifically questioned whether schools have awarded contracts to manufacturers for sale through third-party retailers and whether these contracts include provisions fixing minimum resale prices. Such arrangements could violate restrictions on resale price maintenance.
Furthermore, the CMA questioned the extent of branding and tailoring on school uniforms, suggesting that while unique color combinations may enhance identity, they could also limit the number of suppliers willing to invest in stock that can only be sold to a small pool of customers.
To address the financial burden associated with uniforms, the CMA suggested that schools establish second-hand uniform shops, either by redistributing lost property, selling donated clothing, or setting up size-swapping stores. This would help extend the lifespan of existing uniforms and reduce the need for families to purchase new ones.
The CMA also advises parents to compare prices and stay alert for warning signs like pressure selling when purchasing uniforms. They should understand their school's uniform policy, especially regarding branded items and authorized retailers. Even if branded items are only available from one source, parents should compare prices for other items and not be pressured into rushed purchases.
By taking these steps, schools can ensure their uniform policies are fair, transparent, and compliant with competition law, while also minimizing the financial burden on families.
