Unjust Imprisonment and Tragic Death
Damaris Vitória Kremer da Rosa, a 26-year-old woman, passed away on October 26, 2025, due to complications from advanced cervical cancer. Her death occurred a mere 74 days after she was acquitted of a murder charge, for which she had been unjustly imprisoned for six years in Rio Grande do Sul, Brazil.
Kremer da Rosa was initially arrested preventively in August 2019, accused of involvement in the murder of Daniel Gomes Soveral, which took place in November 2018 in Salto do Jacuí. Prosecutors alleged she had lured the victim to the crime scene.
Years Behind Bars and Denied Medical Care
During her nearly six years of incarceration, Damaris Vitória Kremer da Rosa was transferred between several prisons in Rio Grande do Sul, including Sobradinho, Lajeado, Santa Maria, and Rio Pardo. Throughout this period, her defense consistently maintained her innocence, arguing that she had only informed her then-boyfriend, Henrique Kauê Gollmann, that she had been raped by Daniel Soveral, and that Gollmann had acted alone in retaliation.
While imprisoned, Kremer da Rosa began experiencing significant health issues, including vaginal bleeding and severe abdominal pain. Despite these symptoms, her numerous requests for medical attention and release were reportedly denied by judicial authorities. The Rio Grande do Sul Court of Justice, in one instance, stated there was 'no indication of an actual diagnosed condition' and that medical documents were 'just prescriptions, with no indication of an actual diagnosed condition and no exams or medical reports.'
Acquittal and Final Days
It was not until March 2025 that Damaris Vitória Kremer da Rosa's health condition was officially recognized as critical, following a confirmed diagnosis of malignant cervical cancer. Her preventive detention was then converted to house arrest, allowing her to receive treatment. Even under house arrest, she was required to wear an electronic monitoring ankle bracelet, which remained on during medical examinations and treatments.
Her case finally went to trial in August 2025. On August 13, 2025, a jury in Salto do Jacuí unanimously acquitted her of all charges, recognizing her innocence due to a lack of evidence. However, the freedom came too late. Damaris Vitória Kremer da Rosa succumbed to her illness on October 26, 2025, at her mother's home in Balneário Arroio do Silva, Santa Catarina. She was laid to rest the following day in Araranguá, Santa Catarina.
Her lawyer, Rebeca Canabarro, criticized the judicial system, suggesting that an earlier release for proper medical care could have altered the tragic outcome.
