A Guide to CBD and THC Regulations and Compliance in Japan

A recent case involving a prominent Japanese executive and a supplement containing a cannabis-derived component prompted these questions.

The two primary components of interest are THC and CBD. THC is known for its hallucinogenic effects and potential harm, making products exceeding the legal THC limit illegal in Japan. Conversely, CBD is not subject to domestic regulation, and various products like supplements, oils, cosmetics, and foods containing CBD are available, often marketed for their relaxing properties.

While CBD products are generally legal, some may contain THC levels exceeding the permissible limit. This is particularly relevant because THC-containing products are legal in some regions outside Japan, such as certain U.S. states. This can lead to the illegal import of such items or their misrepresentation as compliant products.

The legal framework surrounding cannabis and its derivatives is governed by the revised Narcotics and Psychotropics Control Act, which took effect in December 2024. This act classifies cannabis as a "narcotic," resulting in stricter regulations. Individuals can face criminal charges for the illegal import, export, possession, or use of products with THC levels above the legal threshold. Although the path for pharmaceutical use has been established, no such products are currently approved in Japan. However, individuals with intractable epilepsy may be permitted to use products containing cannabis-derived components after completing specific procedures.

Distinguishing between legal and illegal products can be challenging. The Ministry of Health, Labor and Welfare has provided a list of organizations that test for THC content. Extra caution is advised when importing products, as regulations vary significantly across countries. Products legal in other nations may be illegal in Japan.
