The past week brought significant upheaval for Andy Byron, the former CEO of Astronomer. The married tech executive was caught on the kiss-cam at a Coldplay concert in Foxboro, Massachusetts, engaging in a public display of affection with Kristin Cabot, Astronomer's head of HR, and not his wife. The video quickly went viral, prompting a statement from Astronomer and Byron's subsequent resignation.
Following the scandal, speculation arose regarding potential legal action by Byron. The Mirror US consulted with two attorneys to assess Byron's legal options against the band. Ron Zambrano of West Coast Employment Lawyers in Los Angeles stated that any legal claims from Byron would be unsuccessful, citing a lack of grounds for a lawsuit.
Zambrano explained that any suit would be dismissed due to restrictions on creative expression and the band's artistic freedom. He also noted that Byron and Cabot forfeited their right to privacy by attending a public event, making their actions their own responsibility. Tre Lovell of the Lovell Firm, specializing in civil and entertainment law, agreed, stating that Byron had no legal recourse against Coldplay.
Lovell further clarified that individuals in public spaces have no expectation of privacy regarding their actions. He emphasized that while people are free to photograph and video others, they cannot use those images for commercial purposes or to defame someone. Lovell concluded that the embarrassment stemming from the kiss-cam footage was the responsibility of the individuals involved. Neither Byron nor Cabot have commented publicly on the incident, although Coldplay's frontman, Chris Martin, alluded to it with humor during a later performance.

He's trying to play the victim when he’s the one who betrayed his wife. Pathetic.

I admire Byron's dedication to exploring his options; it shows he cares about his reputation.

We should be more focused on supporting mental health and forgiveness rather than cruelty. Mistakes don’t define a person.

There's no privacy in public—he should know that by now. This just shows his lack of accountability.

No one should feel uncomfortable at a concert because of a silly kiss-cam moment. We need to support each other!

It's embarrassing to see someone in his position act so selfishly. Disgraceful!
